Conversion of House Into Flats: Edgar Mendenhall, managing director of a firm decorators at Orange Sreet, W.C., said that in January, 1037, they gave, at Berndt’s request, an estimate, amounting to £632, for work at 4 Foulis-terrace. Berndt told witness he was converting the house into flats, and that in three months time he would receive a legacy of £5O,OOO from Germany. After the work had been started further alterations were ordered, bringing the bill to £917. In consequence of something he heard witness stopped the work, but resumed it after Countess Elston had signed a guarantee to cover the original estimate. Berndt never paid anything. Judgment was obtained against him and the Countess, and £550 was paid on behalf of the latter, but nothing by Berndt.

MR. SIEVIER AND THE MAYOR - TAXI-CAB ADVENTURE DESCRIBED IN COUNTY COURT. A collision between a taxi-cab, in which Mr. Robert S. Sievier and the Mayor of Shoreditch were riding, and a motor omnibus was described In the Westminster County Court yesterday, when the London General Omnibus Company was awarded 25s for damage to the ominbus against Mr. William Arthur Mendenhall, of Creighton road, Rensal Rise, and Mr. Mendenhall's counter claim of £23 5s for damage to the taxi-cab was dismissed. Costs were allowed on both claims.
The collision occurred at the junction of Southgate-road and Balls Pond-road, shortly after mid-night on a Sunday in May. For the company it was concluded that the responsibility rested with the taxi-cab driver, and it was alleged that the cab was going at a very fast rate, whereas the omnibus was going slowly, and was about to pull up at a regular stopping-place. Thetaxi-cab driver said that he was only driving at six or seven miles an hour.
Mr. Sievier said that he engaged the taxi-cab on the night of the accident, and kept it waiting for him at the Cafe Royal, Horton, for some .considerable time.  He then picked up Mr. Bird (Mayor of Shoreditch), and they drove off togather. Before reaching Balls Pond-road be estimated that the cab was travelling at ten to twelve miles an hour, but before reaching the cross-road the cab slowed down and hooter was sounded several times. The taxi-cab reached the crossing before the omnibus. The speed was slackened considerably, and to a collision the driver swerved to the left with such suddenness that Mr. Bird was throw violently into his (Mr. Sievier's) lap, and the can was nearly overturned. The taxi-cab just failed to clear the omnibus, and came into collision with the staircase.
Mr. H. B. Bird, Mayor of Shoreditch, corroborated Mr. Sievier's evidence. He added that he had always regarded the crossing as a dangerous one, and on this particular occasion he put out his feet in case an accident occurred.
His Honour said that although Mr. Sievier and Mr. Bird were both good witnesses, the evidence as a whole was overwhelmingly in favour of the omnibus company, and gave judgment as stated.

PEDESTRIANS ON CROSSINGS: Their Rights Discussed In Court Action: Rights of pedestrians on Belisha crossings were discussed in an action at Willesden County Court on Tuesday, in which damages were claimed by William Simmons, steel worker, of 118, Harp-road, Greenford-avenue, Hanwell, from William Mendenhall, taxidriver, of 83, Palermo-road, Harlesden, in consequence of injuries received by Mr. Simmons when knocked down at Scrubbs-lane on Jan. 19 this year. Plaintiff was crossing the road opposite Hythe-road on his way home from work, and defendant's taxi ran into him on the pedestrian crossing. Mendenhall said this particular spot was badly lit in normal times. His speed was about 15 miles an hour, and it was not until he reached the crossing that he saw plaintiff. He shouted and swerved to his right, but plaintiff "made a dash for it," and caught the near-side bumper. Giving judgment for Mr. Simmons for £2O and costs, the Deputy Judge remarked that the difficulties in defendant's case were the regulations applying to pedestrian crossings. Defendant's story was not an explanation of how the accident occurred. Plaintiff was entitled to go on the crossing when he did. The taxi-driver approached the crossing much faster than he said, and without due observance of the regulations. In view of those regulations the question of contributory negligence did not arise.
